USE AND RELEASE AGREEMENT
WHEREAS, Hackberry Breeze, LLC (“Owner”) is the owner of that certain property located at 555 Lake Breeze Road, Hackberry, Louisiana 70645 (“Premises”), and is willing to grant the individuals signing this Use and Release Agreement (this “Agreement”) a revocable, non-exclusive right to use the Premises for the purpose of engaging in indoor and outdoor recreational activities, including but not limited to fishing, trapping, and water-related recreational activities (the “Activities”), upon the terms and conditions of this Agreement; and
WHEREAS, the undersigned individual identified on the signature page below (hereinafter referred to as “I” or “me”), individually and on behalf of the undersigned’s minor children (if any), desires to enter upon and utilize the Owner’s Premises, for the purpose and Activities stated herein and in accordance with the restrictions, terms and conditions of this Agreement.
NOW THEREFORE, in consideration of being permitted by the Owner to enter upon and utilize the Premise for the purposes and Activities stated herein, and in recognition of the Owner’s reliance hereon, I, individually and on behalf of my minor children (if any), agree to the following terms and conditions:
I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ AND UNDERSTAND EACH OF THE ABOVE PROVISIONS AND THAT I HEREBY AGREE, PERSONALLY AND ON BEHALF OF MY MINOR CHILDREN (IF ANY), TO BE BOUND BY THE TERMS OF THIS AGREEMENT. BY SIGNING THIS AGREEMENT I FURTHER GUARANTEE THAT I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND THEREFORE FULLY COMPETENT IN AGREEING TO THIS AGREEMENT.

EXHIBIT “A” TO USE AND RELEASE AGREEMENT
RULES AND REGULATIONS GOVERNING ALL ACTIVITIES ON PREMISES
1. Prohibited Activities. Neither I, my minor children, nor any person on the Premises shall:
A. Engage in indoor and outdoor recreational activities while under the influence of any alcoholic beverage, drug, or controlled substance (other than a prescription drug taken by the person for whom it is prescribed in the dosage listed).
B. Engage in indoor and outdoor recreational activities unless in possession of a valid, current license to participate in such activity, as and to the extent required by the laws of the State of Louisiana.
C. Enter on the Premises in possession of any firearm unless he or she possesses a valid, current license or permit in good standing to own, possess, or operate the specific weapon, including but not limited to firearm, bow, or fishing rod, that he or she brings onto, or discharges on, the Premises, as and to the extent required by the laws of the State of Louisiana.
D. Shoot or discharge a firearm, bow, or other weapon (i) from a vehicle (whether moving or stationary, or (ii) in the direction of any building, house, dock, or other improvement upon the Premises, or across any road, entry, walkway, or path located on the Premises.
E. Harass, discharge, or threaten to discharge a weapon at or endanger any other person on the Premises.
F. Build or allow fires on the Premises, except in those areas specifically designated by Owner, and, in such event, I shall be solely responsible for the control, dousing, and care of such fires, and I shall be solely and fully liable for any damage caused by such fires or by the failure to control, douse fully, or care for such fires or by any other negligence of willfulness with regard thereto.
G. Cause any damage to any house, building, structure, dock, or other improvements located on the Premises.
2. Mandatory Activities. I, my minor children, and any person on the Premises shall at all times:
A. Carry with them and provide for inspection upon request by Owner or its representatives, a copy of any license, permit, certification, or other authorization for the indoor and outdoor recreational activities in which they are participating, as and to the extent required by the laws of the State of Louisiana, and for any weapon(s), including firearms, bows and fishing equipment, in their possession, as and to the extent required by the laws of the State of Louisiana.
B. Act in accordance with the best hunting and fishing practices, and best practices with regard to the use and discharge of any weapon(s), including firearms, bows and fishing equipment, particularly with regard to the welfare and safety of other person on or in the vicinity of the Premises.
C. Remove all garbage, including but not limited to waste from fishing activities and animal carcasses or guts from cleaning a carcass, and other evidence of fishing or hunting activities on the Premises.
D. Report to Owner or its representatives any observed or suspected infraction of this Agreement as soon as practicable after observing them.
E. Report any observed or suspected injuries (other than minor injuries requiring minimal first aid on the scene) to an person on the Premises immediately, and seek immediate medical attention for such injuries, and report said injuries to Owner and its representatives as soon as practicable after observing them.
F. Leave the Premises in at least as good condition as upon entry thereon.
